Kenneth Weatherwax, co-managing partner at Lowenstein & Weatherwax LLP, was quoted in an article published by Law360 on May 1, 2010 addressing a new neutral resolution program for patent infringement claims involving products offered for sale by sellers on Amazon’s website. Mr. Weatherwax, who is not involved in the program, observed that this novel program, which resolves allegations of patent infringement for a flat $4,000 fee and offers only a remedy of removal of products from the website rather than monetary compensation, in some ways resembles arbitration and in some ways resembles the much more elaborate proceedings before the International Trade Commission.
