The Patent Trial & Appeal Board denied institution of a petition for inter partes review brought by Honda challenging Neo Wireless’s US 10,771,302 patent.   The Board denied the petition on the merits, finding that Honda has failed to show a reasonable likelihood of prevailing as to any challenged claims.  Last year, the Board had exercised its discretion to deny the same petition on the basis that Honda’s co-defendant, Volkswagen, had unsuccessfully challenged the same patent.  The Director of the USPTO vacated that decision and remanded the matter to the Board for a decision on the merits.  The L&W team was led by Parham Hendifar and Kenneth Weatherwax.
