Lowenstein & Weatherwax LLP founding partner Nathan Lowenstein was quoted in an article published December 17, 2015 by Law 360, “PTAB Urged to Nix Eye-Tracking IP Used Against Xbox,” by Michael Macagnone. Mr. Lowenstein and fellow founding partner Kenneth Weatherwax defended the IPLearn-Focus U.S. Patents 8,475,174 and 8,538,321 (USPTR numbers 2015-00095 and 2015-00097) against petitioner Microsoft Corporation’s reasoning before the Patent Trial and Appeals Board during oral arguments in an Inter Partes Review challenging the patents. The Board previously instituted review on a subset of the IpLearn-Focus patents and claims challenged by Microsoft, which are the subject of infringement litigation between the two companies.
