In a U.S. Patent and Trademark Office reexamination proceeding involving Utherverse Gaming LLC’s patent No. 8,276,071, the examiner issued a notice removing all rejections and confirming the patentability of every remaining challenged patent claim in the case.  The ’071 patent claims innovative animation methods usable in multi-user computer gaming.  The ex parte reexamination of the patent was requested by Epic Games, Inc., a company that has been accused in federal court of infringing the claims.  The examiner concluded that multiple art references relied upon by Epic in its reexamination request were not prior art, because the challenged claims were entitled to an earlier invention date than the date of the references.  Utherverse Gaming is represented in the proceeding by Kenneth Weatherwax and Robert Pistone of Lowenstein & Weatherwax LLP.  The examiner’s March 13, 2024 Notice may be accessed at this link.
