Kenneth Weatherwax, co-managing partner at Lowenstein & Weatherwax LLP, was quoted in an article published by Law360 on October 1, 2019 regarding the recent wave of “precedential’ decisions of the USPTO’s Patent Trial and Appeal Board as the result of newly adopted procedures.  The article quoted Mr. Weatherwax’s observations about the rate at which the Board’s new “Precedential Opinion Panel” was granting requests for rehearing of non-precedential Board decisions, and that there had been “nothing less than a revolution” in the Office’s designation of decisions as precedential and binding.  The article may be accessed (subscription required) at this link.
