Lowenstein & Weatherwax LLP caps the week ending August 27, 2021 with significant IPR, Federal Circuit, and 9th Circuit wins.
On Monday, August 23, 2021, L&W secured a complete IPR trial win on behalf of its client DivX, LLC, L&W’s fourth consecutive complete trial win on behalf of DivX. This most recent case was co-tried by Parham Hendifar and Nathan Lowenstein.
On Thursday, August 26, 2021, L&W obtained another Federal Circuit victory on behalf of VLSI Technology LLC. Intel had sought panel and en banc rehearing of its 12 appeals that the Federal Circuit previously dismissed. After briefing by the parties, the full Federal Circuit rejected Intel’s requests for rehearing. The L&W team included Nathan Lowenstein and Kenneth Weatherwax.
Last but not least, on Friday, August 27, 2021, L&W obtained a landmark 9th Circuit victory on behalf Ayla, LLC. Ayla’s complaint for trademark infringement had been dismissed for lack of personal jurisdiction. L&W took the case over on appeal and secured a reversal of the dismissal below, the first published 9th Circuit case to find nationwide personal jurisdiction under Federal Rule of Civil Procedure 4(k)(2). The L&W team included Bridget Smith, Gregory Smith, Peter Gregora, and Colette Woo.
