Lowenstein & Weatherwax LLP sought and obtained Director Review on behalf of MOSAID Technologies Inc. of IPR2025-01171 which had been instituted. The decision granting Director Review, authored by Director John A. Squires, Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office, vacates the institution decision and denies review on account of the petitioner’s inconsistent claim construction positions between the district court and the IPR petition. The L&W team included Nathan Lowenstein, Dennis Courtney, and Colette Woo. This same team obtained two additional noninstitutions on behalf of MOSAID on February 10, 2026.
