Lowenstein & Weatherwax scored significant inter partes review (IPR) victories in the US Patent & Trademark Office’s Patent Trial and Appeal Board on behalf of its clients Free Stream Media Corp. (d/b/a Samba TV) and Sound View Innovations, LLC.
On January 25, 2018, the Board denied in their entirety both petitions for IPR brought by Alphonso, Inc. against Lowenstein & Weatherwax’s client Free Stream Media. Both decisions adopted L&W’s arguments and denied institution in full on the merits.
Also on January 25, 2018, the Board terminated the final three IPRs brought by Facebook, Inc. against L&W’s client Sound View Innovations. Facebook brought a total of eight petitions for IPR of Sound View’s patents. L&W persuaded the Board to deny institution of review in five of eight cases in their entirety, and to institute review as to only a subset of challenged claims in two of the remaining three. The three IPRs not denied outright have now been terminated by the Board at the request of the parties, based on an agreement to license the patents, rejecting attempts by third parties to keep the proceedings from being fully terminated.
These most recent victories add to L&W’s extraordinarily successful track record defending patent owners in IPR and related matters before the Patent Trial and Appeal Board.
