Kenneth Weatherwax, co-managing partner at Lowenstein & Weatherwax LLP, was quoted in Law360’s August 3, 2022 lead article covering the introduction by U.S. Senator Thom Tillis of a bill that would make important amendments to the Patent Act to set more precise rules for when inventions and discoveries can be eligible for patent protection. Eligibility law is considered to have become unclear following recent Supreme Court decisions addressing non-statutory exceptions to eligibility. Mr. Weatherwax was quoted as observing that the proposed bill would “upend” many recent appellate decisions interpreting the Supreme Court’s eligibility jurisprudence. He also noted that, as the Supreme Court had declined to clarify its rulings, Congress appeared to have few options other than such statutory amendments if it wished to clarify the law.
