Bridget Smith, partner at Lowenstein & Weatherwax LLP, was quoted in an article published by Bloomberg Law on September 18, 2019, regarding the USPTO’s brief to the Federal Circuit urging the court to give deference to decisions by the Patent Trial and Appeal Board’s Precedential Opinion Panel (POP).  The article quoted Ms. Smith’s observations that the USPTO argues the panel’s adjudicative rulemaking is entitled to the same deference as notice-and-comment rulemaking.  The article may be accessed (subscription required) at this link.
