Along with co-counsel Feinberg Day Kramer Alberti Lim Tonkovich & Belloli LLP, Lowenstein & Weatherwax LLP secured four out of four denials of institution in inter partes reviews on behalf of client Express Mobile, Inc (XMO), a pioneering leader in Web 2.0 and mobile technology. Petitioner Google challenged four of XMO’s U.S. patents 6,546,397, 9,063,755, 9,471,287, and 9,928,044. On October 4, 2021, the Board issued separate decisions finding that Google was not reasonably likely to succeed on any of its petitions for inter partes review. The cases were handled by L&W partner Bridget Smith.
