On February 5, 2015, L&W’s Roman Melnik, lead counsel in Kimble v. Marvel Enterprises, was quoted by Law 360 as saying that he welcomed the briefs amicus curiae filed with the U.S. Supreme Court in support of L&W LLP’s clients’ position. Melnik stated that he was “very gratified by the broad support received from a wide variety of amici”—including among others, trade associations, university and research institutions, and many distinguished legal scholars and economists. The Kimble case will be heard by the U.S. Supreme Court this year and seeks to overturn the Supreme Court’s 50-year old decision in Brulotte v. Thys Company, which established a prohibition against enforcement of royalty obligations based on patent license agreements if the licensed patent rights have expired.
