L&W Submits Amicus Curiae Brief to U.S. Supreme Court on Behalf of Antitrust Law Professors

Lowenstein & Weatherwax filed an amicus curiae brief in the United States Supreme Court today on behalf of six law school professors specializing in antitrust scholarship.  The scholars’ friend-of-the-court brief urged the Court to grant a writ of certiorari in the case of AFMS LLC v. United Parcel Service, Inc. and FedEx Corporation (No. 17-1092),which presents questions of when horizontal group boycotts are per se illegal and when “quick look” economic analysis is appropriate under Section 1 of the Sherman Act.
